Acceptance of this agreement is implied by requesting Entrypoint's services. Payment is not due until you are satisfied with our website design. No domain name will be registered for you until you have signed this agreement and have paid 1 years fees in advance.

The e-mail addresses and addresses supplied to Entrypoint will be used to communicate with you and such communications may carry advertising or notification of offers. Entrypoint is a company run and operated by Waynne Smith. For security purposes an address has not been posted on this web site but I will to supply my contact details to any of Entrypoint's customers.

Entrypoint will register a Domain name on your behalf and it will remain the property of Entrypoint until a release fee is paid. Domains purchased on your behalf by Entrypoint may be transferred to another internet service provider for domain hosting upon written instruction from the original requester subject to a small charge for administration.

Payment of registration fees to Entrypoint does not imply acceptance. Where it transpires that a Domain applied for is unavailable, delayed, declined or for any reason the registration is cancelled by any authority or if any error or technical fault by any party results in the loss of the Domain then the purchaser may be reimbursed in full the payment made in respect of that Domain but shall not be entitled to any further compensation.

No Domain is considered to be registered until the name of the Registrant appears in the registration authority's database. The Registrant is strongly advised not to announce the Domain until the registration is complete and further to verify registration via Entrypoint. The process of registration takes several days from application and the rules of acceptance are controlled by the authorities.

Successful registration of a Domain does not imply the legal right to use that Domain. Please do not ask Entrypoint to register offensive words or names which may infringe the trademarks, trading names or property rights of others. The domain authorities have the right to withdraw offending Domains and under such circumstances Entrypoint will not be liable for any compensation or refund.

If you fail to renew a Domain registration (the minimum registration period is 2 years) then your registration will lapse and you will lose all rights to your Domain. Renewal of a Domain purchased through Entrypoint can be facilitated via Entrypoint. Normal charges apply. Failure to make a payment to Entrypoint will result in a message being prominently displayed on your website to explain that 'the site is unavailable due to unpaid fees' and could eventually lead to the withdrawal of Entrypoint's services. A domain name will not be released unless outstanding payment is made and the prevailing cancellation charge is paid to Entrypoint (currently £75).

Entrypoint may make changes to the Entrypoint Services without notice or notification for any reason and details of such changes will normally be posted on the website www.d8a.co.uk. (Any amendments to this agreement will require a signature from you before you become bound by them see 23.)

Your dealings with and interest in promotions, services, or merchants found on or via the Entrypoint's Services are unless explicitly stated solely between you and the person or company with whom you are dealing and accordingly Entrypoint accepts no liability in this regard. Entrypoint does not endorse any products advertised.

You shall not use the Entrypoint Services to publish, link to, request posting or otherwise transmit: 10.1. any material that is defamatory, pornographic, obscene, indecent, abusive, offensive, menacing or which may incite violence, cruelty or racial hatred, or which is in any other way unlawful; 10.2. any material that infringes the copyright, trade mark or other intellectual property rights of any party; 10.3. unsolicited promotional e-mail or other bulk e-mail (spam)

Entrypoint may at any time without notification or notice to you remove from any server used or operated by Entrypoint or our hosting company in the provision of the Entrypoint Services any information including any website pages posted or transmitted on your behalf in breach of the provisions of this Agreement. Decisions on such matters will be entirely at the discretion of Entrypoint and the material removed will be destroyed or disabled.

You shall not invade the privacy of other users of the Entrypoint Services or the Internet in general and you shall when using the Entrypoint Services comply with any applicable data protection legislation currently in force, respect copyrights and take full responsibility for all the content of the website Entrypoint produce for you.

You are also responsible for backing up any information or other data submitted to Entrypoint by you and Entrypoint will not be liable for any loss or corruption of such information or data including the loss of incoming or outgoing message data or information in any form without exception. Please keep a back-up copy.

You acknowledge that the information available on the Internet may contain material of an indecent, offensive or unlawful nature. Entrypoint has no control over such information and you acknowledge that Entrypoint is not responsible for such information and does not knowingly allow such information to be published by users of the Entrypoint Services. You download or transmit such material at your own risk.

Entrypoint does not guarantee continuous or uninterrupted use of the Entrypoint Services, especially where Entrypoint or our hosting company finds it necessary to carry out routine maintenance, repairs, reconfigurations or upgrades or where there are circumstances beyond its control. Entrypoint cannot and will not be liable to you for any failure of or interruptions to the Entrypoint Services.

Entrypoint will not be liable for the content or effect of any program, item, material, information or data which may be received via any Entrypoint service or associated service including software viruses.

Entrypoint gives no warranties, conditions or representations, express or implied, statutory or otherwise in relation to the Entrypoint Services or the Offers. Nothing in this agreement affects your statutory rights.

Entrypoint does not exclude or limit its liability in negligence for death or personal injury, or for fraud, or otherwise insofar as any exclusion or limitation of its liability is void, prohibited or otherwise unenforceable by law. Subject to this, Entrypoint is not liable and will not be liable under any circumstances for any loss or damages which result or may result from your use of the Entrypoint's Services (included but not limited to corruption or loss of data, defects or delays in transmission or any failure or unavailability of the Entrypoint Services) or for any reliance on or use of information, services or goods purchased on or through the Entrypoint Services. Entrypoint is also not liable to you for any act or omission of any other entity furnishing products or services which are required by you to use the Entrypoint Services.

You undertake to fully indemnify and keep indemnified at all times Entrypoint against all costs, claims and expenses suffered by Entrypoint as a result of your breach of the terms of this agreement or of any law, regulation or code of practice relating to the Entrypoint Services.

You may terminate your use of Entrypoint's Services at any time subject to the payment of a fee of £75 at which time the domain name entrypoint registered for you would then transfer into your name and would be released for transfer to another hosting company.

Upon termination of your use of the Entrypoint's Services (however caused) Entrypoint will remove from any server used or operated by it in the provision of Entrypoint's Services all information and data posted by you (including any website pages) and will deny you access to the our services. However, any Domain registered through us shall remain so registered subject to payment of renewal fees when due.

If any of the provisions of this agreement are found by any court to be invalid or unenforceable the invalidity or unenforceability of such provision shall not affect the other provisions of this agreement and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect. Failure or neglect by us to enforce at any time any of the provisions of this agreement shall not be deemed a waiver of Entrypoint's rights hereunder nor prejudice Entrypoint's rights to take any subsequent action.

These conditions shall be governed by and construed in accordance with English Law. Both you and Entrypoint hereby irrevocably submit to the non-exclusive jurisdiction of the English Courts for the purpose of hearing and determining any dispute arising out of this agreement and for the purpose of enforcement of any judgement.
